Terms of Service

Effective 2026-10-23

These Terms of Service (“Terms”) are an agreement between you and Taylor A Caldwell (“FameMaker,” “we,” “us”) for your use of the FameMaker app, web app and website (the “Service”). By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you use the Service for a business, you agree on its behalf.

1. Eligibility and your account

You must be at least 18 years old. Give accurate information, keep your password secure and tell us promptly at support@famemaker.app if you think your account has been accessed without permission. You are responsible for activity on your account.

2. Your obligations

You agree to follow these Terms, the law, and the terms and community rules of every platform you connect (such as Instagram, TikTok, YouTube and Meta). You are responsible for the content you approve and publish, including any disclosure that it was created or altered with AI, or that it is sponsored, where a platform or the law requires it.

3. Authorized content and likeness rights

You may upload content and create AI characters only from images, voices and other material that you own or have permission to use. For every real person shown in a photo or used as a character reference, you confirm that the person is an adult who has given you permission (or that the person is you), and that your use does not violate anyone’s rights of privacy or publicity, copyright or trademark. We may ask for proof and may remove content or characters when rights are unclear.

4. Acceptable use

You may not use the Service to:

5. AI-generated content

The Service uses outside AI services to help create captions, images and videos. AI output may be inaccurate, unexpected, or similar to content created for others, and it may not be protected by copyright. Review everything before you publish it. Our safety controls may block or change requests. AI features require your permission to send information to AI providers, as described in the Privacy Policy.

6. Content ownership and licenses

Your content stays yours. You keep ownership of what you upload and, as between you and us, of the output created for your account, to the extent the law allows ownership. You give us a limited, worldwide, non-exclusive, royalty-free license to host, copy, process, adapt and transmit your content only as needed to provide and secure the Service, including sending it to AI providers with your permission and publishing it to the accounts you connect. This license ends when your content is deleted, except for copies kept as described in the Privacy Policy. We own the Service, its software, brand and design.

7. Platform integrations

Connected platforms are operated by third parties under their own terms. What FameMaker can do (for example, which post types can be scheduled or which statistics can be read) depends on each platform’s API and approvals, which can change or stop without notice. We are not responsible for platform outages, policy changes, content removals, account restrictions or changes to how platforms distribute content.

8. No guarantee of results

FameMaker does not guarantee any number of followers, views, likes, engagement, income or virality, and does not control any platform’s recommendation algorithm. Recommendations, trend research, experiments, levels and leaderboards are tools to help you make decisions; results depend on your content, audience, platforms and many factors outside our control. Fame Game points, levels and awards have no cash value and cannot be transferred.

9. Subscriptions and billing

Some features require a paid subscription or purchase. Prices and what each plan includes are shown before you buy. Subscriptions renew automatically at the end of each period until you cancel.

We will give advance notice of price changes, and you can cancel before they take effect.

10. Cancellation and refunds

When you cancel, your plan stays active until the end of the period you paid for, and is not renewed. Except where the law requires otherwise, payments are not refundable and partially used periods are not refunded. Refunds for purchases made through Apple are handled by Apple at reportaproblem.apple.com. Deleting your account does not cancel an Apple subscription; cancel it in Settings first.

11. Suspension and termination

You can stop using the Service and delete your account at any time (see Delete your account). We may suspend or end your access, or remove content, if you break these Terms, if your use creates risk or legal exposure for us, others or a platform, or if we stop offering the Service. Where reasonable, we will tell you why and give you a chance to fix the problem. Sections that by their nature should survive (such as ownership, disclaimers, limits of liability and disputes) survive termination.

12. Disclaimers

The Service is provided “as is” and “as available.” To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement, and we do not promise the Service will be uninterrupted or error-free.

13. Limitation of liability

To the fullest extent the law allows, FameMaker will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, followers, revenue, data or goodwill. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim or US $100. Some places do not allow these limits, so they may not apply to you.

14. Indemnity

You will defend and indemnify FameMaker against claims arising from content you upload or publish, your use of anyone’s likeness, or your breach of these Terms or the law.

15. Governing law and disputes

These Terms are governed by the laws of the State of Tennessee, USA, without regard to conflict-of-law rules. Before filing a claim, you agree to contact us at support@famemaker.app and try to resolve the dispute informally for 30 days. Any dispute that is not resolved will be brought in the state or federal courts located in Tennessee, and both parties consent to their jurisdiction, except that either party may bring a qualifying claim in small-claims court. Nothing here limits rights you have under the consumer protection laws of where you live.

16. Apple App Store

If you downloaded the app from the App Store, these Terms are between you and FameMaker, not Apple. Apple has no obligation to provide maintenance or support, is not responsible for claims relating to the app, and is a third-party beneficiary of these Terms with the right to enforce them against you. Apple’s standard licensed application terms apply to the extent they do not conflict with these Terms.

17. Changes

We may update these Terms. We will post the new version here with a new effective date and tell you in the app or by email about material changes before they take effect. Continuing to use the Service after that means you accept the changes.
